This website is operated by Ecomsonic LLC, trading as Harrington & Wells. Throughout these terms, "we", "us" and "our" refer to Ecomsonic LLC. By visiting this site or placing an order you agree to the terms set out below, together with the policies linked from them. If you do not accept them, please do not use the site.

1. Online store terms

You confirm that you are at least the age of majority in your state of residence, or that you have given consent for any minor in your care to use this site. You may not use our products for any unlawful purpose, and you may not breach any law applicable in your jurisdiction while using the service. A breach of these terms ends your right to use the site immediately.

2. General conditions

We may refuse service to anyone, at any time, for any lawful reason. You understand that content other than your payment details may travel unencrypted across networks and may be altered to meet the technical requirements of connecting systems. Payment card information is always encrypted in transit. You agree not to reproduce, resell, or exploit any part of the service without our written permission.

3. Accuracy, completeness, and timeliness of information

The material on this site is provided for general information and should not be treated as the sole basis for a decision. Some of it may be historical, and historical material is kept for reference only. We are under no obligation to update it, though we may change site content at any time. Monitoring changes to this site is your responsibility.

4. Products and availability

Products are offered subject to availability and may be withdrawn at any time. We describe each item as accurately as we can, including materials and measurements, but we cannot guarantee that your screen reproduces colour exactly. Where an item you have ordered proves unavailable, we will tell you and refund that item in full.

5. Prices and payment

Prices appear in United States dollars and may change without notice before an order is placed. Sales tax is calculated at checkout where it applies to your delivery address. The total shown before you confirm is the amount taken. Accepted payment methods, the timing of the charge, and how card details are protected are described on our Payment Policy page.

6. Orders, billing, and account information

Your order is an offer to buy, and a contract arises only when we send the dispatch confirmation. We may limit or cancel quantities purchased per person or per order, and we may decline an order where an item is unavailable, where a price or description was published in error, or where payment cannot be verified. You agree to supply current and accurate purchase and account details, and to keep them updated so that we can complete your order and contact you. If you hold an account, keeping your credentials confidential is your responsibility; tell us promptly if you believe it has been used without your permission.

7. Shipping and delivery

Orders are prepared in 1 to 3 business days (Monday to Friday) and travel for a further 6 to 10 business days, giving 7 to 13 business days in total. Our daily cutoff is 6:00 PM (EST). We ship free of charge within the United States only. Full terms, including tracking and delays, are in our Shipping Policy, which forms part of these terms.

8. Returns and refunds

Returns are accepted within 30 days of delivery on items that are unworn, unused, and returned with their original tags and packaging. We charge no restocking fee, and approved refunds are returned to the original payment method within 7 business days (Monday to Friday) of approval. The conditions in our Return and Refund Policy apply in full and form part of these terms.

9. Personal information

Personal information submitted through this site is handled as described in our Privacy Policy.

10. Optional tools and third-party links

We may give you access to third-party tools that we neither monitor nor control. Any such tool is provided as-is and without warranty of any kind, and your use of it is at your own risk. Certain content and offers from third parties may appear on this site, and links may take you to sites we do not operate. We are not responsible for their content, accuracy, or practices, and you should review their terms before engaging with them. Complaints about a third party should be directed to that third party.

11. User comments and feedback

If you send us suggestions, proposals, or other material, whether at our request or not, we may use, edit, copy, and publish it without restriction and without any obligation to pay you or to keep it confidential. We may, but are not obliged to, remove material we judge unlawful, offensive, or otherwise objectionable. Anything you submit must not violate the rights of a third party, must not contain malicious code, and must not be false or misleading.

12. Errors, inaccuracies, and omissions

Occasionally information on this site may contain a typographical error, an inaccuracy, or an omission relating to a description, price, promotion, shipping charge, or availability. We may correct such an error and change or cancel an affected order, including after the order has been submitted, and we will contact you if we do. Except as required by law, we are under no obligation to update information on the site.

13. Prohibited uses

In addition to the restrictions above, you are prohibited from using the site or its content for any unlawful purpose; to solicit others to perform unlawful acts; to infringe our intellectual property or that of others; to harass, abuse, defame, or discriminate; to submit false or misleading information; to upload or transmit viruses or any code that will affect the operation of the service; to collect or track the personal information of others; to spam, phish, crawl, or scrape; for any obscene or immoral purpose; or to interfere with the security features of the service. We may terminate your use of the service for breaching any of these.

14. Disclaimer of warranties and limitation of liability

We do not guarantee that your use of the service will be uninterrupted, timely, secure, or error-free, and we do not warrant that results obtained from it will be accurate or reliable. Except where we state otherwise in writing, the service and all products delivered through it are provided as-is and as-available, without warranty of any kind, to the fullest extent permitted by law. To the extent permitted by law, our liability arising from any order is limited to the amount you paid for that order, and we are not liable for indirect, incidental, or consequential loss. Nothing in these terms excludes liability that cannot lawfully be excluded, and your statutory rights as a consumer are unaffected.

15. Indemnification

You agree to indemnify and hold harmless Ecomsonic LLC, its officers, employees, and suppliers from any claim or demand, including reasonable legal fees, made by a third party arising out of your breach of these terms or the documents they incorporate, or your violation of any law or the rights of a third party.

16. Severability

If any provision of these terms is found to be unlawful or unenforceable, that provision is severed to the minimum extent necessary and the remaining provisions continue in full force.

17. Termination

Obligations and liabilities incurred before the termination date survive the end of this agreement. These terms remain in effect until terminated by either of us. You may terminate by ceasing to use the site. We may terminate at any time without notice if you fail, or we suspect you have failed, to comply with any part of these terms, and you remain liable for amounts due up to that date.

18. Entire agreement

These terms, together with the policies published on this site, form the entire agreement between us and supersede any prior understanding. A failure by us to exercise any right under these terms is not a waiver of that right. Any ambiguity is not to be construed against us as the drafting party.

19. Governing law

These terms are governed by the laws of the State of Wyoming, United States, and any dispute is subject to the jurisdiction of the courts of that state.

20. Changes to these Terms

The current version is always available on this page. We may update or replace any part of these terms by posting a revision here, and it is your responsibility to check for changes. Continuing to use the site after a revision is posted constitutes acceptance of it. The version published when you place an order is the version that governs that order.
